1. Orders & Payments
1.1 You may order artwork by following the instructions on our website. www.litsaveldekis.com (“the gallery”)
1.2 Unless otherwise stated, all prices are quoted in Australian Dollars (AUD). Prices displayed on the Gallery are subject to change without notice. Once an order has been accepted by us, the price of the artwork cannot be changed unless agreed in writing between you and us.
1.3 All artwork must be paid for in full prior to delivery. You are responsible for any applicable taxes or transaction fees associated with your purchase.
1.4 We reserve the right to decline any order and may cancel an order at any time before the artwork is dispatched.
1.5 We are not responsible for any order failures, delays, or non-acceptance due to internet disruptions.
1.6 Except as outlined in clauses 1.7 and 1.8, all purchases are final. We do not offer refunds for change of mind or if you no longer wish to proceed with the purchase.
1.7 At our absolute discretion, we may offer a store credit (to the value of your original purchase) if you wish to exchange artwork for another piece available on the Gallery. This is only available if the artwork and its original packaging are returned in perfect, undamaged condition.
1.8 If the artist has already been paid for the artwork, any commission or discounts paid to third parties must be returned before the credit can be issued. A restocking fee of 15% of the sale price will apply.
2. Accuracy of Information
2.1 While we strive to ensure all content is current and accurate, information on the Gallery is sometimes sourced from third parties. We do not guarantee the accuracy, currency, or reliability of such third-party information.
2.2 Each artwork is represented by one or more photographs. While these are true representations, you acknowledge that shape, dimensions, and colours may appear slightly different due to screen settings or lighting conditions.
3. Shipping & Insurance
3.1 We only deliver within Australia to a physical street address (no PO boxes). You must provide a valid delivery address at checkout.
3.2 Shipping costs depend on the size and weight of the artwork and will be communicated to you during the ordering process.
3.3 All artwork is shipped with insurance, covering the period from dispatch to delivery at the nominated address.
3.4 Anyone present at the delivery address is deemed authorised to accept the delivery on your behalf. We may request photo ID or credit card verification upon delivery, especially for credit card payments.
3.5 Risk and title in the artwork pass to you once it is delivered to your nominated address.
4. Limitation of Liability
4.1 All artwork is sold "as is."
4.2 To the fullest extent permitted by law, we:
(a) Exclude liability for:
Any form of loss or damage, including loss of profits, business interruption, goodwill, or data.
Loss or damage resulting from circumstances beyond our control.
Damage or theft of artwork post-delivery (unless covered by shipping insurance).
Loss caused by reliance on third-party information displayed on our website.
(b) Exclude all implied terms, guarantees, and warranties unless required by law.
(c) Limit our total liability for any loss or damage to the purchase price of the artwork.
4.3 If a non-excludable guarantee under Australian law applies, our liability is limited (where legally allowed) to:
Replacement of the artwork;
Repair of the artwork;
Payment for replacement; or
Payment for repairs.
4.4 You agree that:
Your use of the artwork is at your own risk;
We do not guarantee that the artwork will suit your intended purpose;
No advice or representation (written or verbal) creates additional warranties unless required by law.
5. Indemnity
You agree to indemnify and hold harmless Litsa Veldekis Pty Ltd. (and its employees, agents, officers, and affiliates) from any claim or liability arising from your breach of these terms or your violation of any law or third-party rights during your use of the Gallery.
6. Amendments to Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will take effect immediately upon being published on our website.
7. General Provisions
7.1 These Terms & Conditions constitute the entire agreement between you and us regarding your purchase of artwork.
7.2 Title and risk pass to you upon dispatch. We are not responsible for delivery delays caused by third parties.
7.3 A waiver of any right under these Terms does not imply future waiver of the same or other rights.
7.4 If any term is held to be unenforceable, that part will be severed, and the remaining terms will remain in full effect.
7.5 These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of that state.
8. Privacy
8.1 By placing an order, you consent to us collecting and using your personal data (excluding payment details) for order fulfilment and for future marketing communications related to our artwork.
8.2 You may request access to or correction of your data by contacting us in writing. We may charge a small processing fee for access requests.
